An affidavit of Devendant stating among other things that he is not the father of the bastard child of JENNY MCGLAMERY, and on motion made, the court ordered the Scire Facias issued in this case to be called in & set aside & the judgement of July Term, to also be set aside, & the case opend for trial, with leave to the Defendant to take issue upon the fact of his being the father. It is ordered that DAVID COOK pay into court $60 whereof $20 be paid instanter, $20 at the Spring Session 1838, and $20 at the Spring Session of 1839 to be appropriated by the Court to the support of the bastard child of SUSANNAH MCGLAMERY, of which he stands convicted as the ruputed father; and that scire facias issue to him to make this conditional judgment absolute as the same fall due from year to year, & being unpaid sa fa for 1 year pay iss'd to July 1837.
